Biden Administration Announcement | Staff Vaccine Mandate | August 2021

Last week the Biden Administration announced forthcoming regulations that will require staff vaccination against COVID-19 for all Medicare and Medicaid participating nursing homes. The proposed regulation is still in development and has not yet taken affect.

Although details to this proposal have not been disclosed, the new requirement is described by a CMS press release as “a key component of protecting the health and safety of nursing home residents and staff by ensuring that all nursing home staff receive COVID-19 vaccinations.

The rule-making process for this mandate will require several weeks and has evoked input from the American Health Care Association (AHCA); our industry’s leading advocacy organization.

AHCA President/CEO Mark Parkinson stated:

“… this action does not go far enough. The government should not single out one provider group for mandatory vaccinations. Vaccination mandates for health care personnel should be applied to all health care settings.”
AHCA is requesting that the Biden Administration evaluate a broader approach to protecting the vulnerable population that we serve.”

Additionally, the Pfizer-BioNTech vaccine has now received approval by the US Federal Drug Administration.  This is the first approval for use of a COVID-19 vaccine outside of the Emergency Use Authorization (EUA) granted in December of 2020.
